On Wednesday, his ex-wife filed a lawsuit on behalf of their 2-year-old daughter against Rep. Max Miller, the troubled Ohio congressman who is struggling to hold onto his seat after claims of abuse, over the unintentional distribution of the child's naked photo.
Emily Moreno filed a civil rights lawsuit in federal court in Ohio, alleging that Miller "recklessly published" the image when he and his lawyer, Aaron Minc, emailed a link to a Dropbox folder containing the private photo earlier this month.
A representative of Miller and Minc has been contacted by CNN to comment on the recent complaint.
The image was publicly available for about a day before being removed.
“Unfortunately, I missed the last three pages of a 40+ page document with sensitive content,” Minc previously said in a statement to CNN. “It was completely unintentional and a mistake. The moment I discovered the issue on Monday morning, I corrected the file immediately.”
After the event, Miller called the image "awful" and stated he was "not defending" its inclusion in the documents in an interview with CNN's Jake Tapper. "I wouldn't say that it's shockingly reckless," Miller said in response to Tapper's description of it as "shockingly reckless behavior by you and your team."
Miller stated, "My lawyer accepted full responsibility." "That was never intended to be done."
Sen. Bernie Moreno of Ohio, Emily Moreno's father, was similarly incensed by the picture and declared that his ex-son-in-law ought to resign from Congress.
The girl is a "entirely innocent victim who has become collateral damage to her father's political ambition," according to a statement released on Wednesday by Emily Moreno's lawyer, Subodh Chandra.
"We intend to hold them fully accountable under federal and state law, and they victimized an innocent child to score political points," Chandra declared.
According to the lawsuit, Moreno is requesting $150,000 in damages for each time the picture was downloaded on behalf of her daughter.
Miller resisted calls earlier this month to withdraw from his congressional campaign and demanded an investigation into his alleged behavior by the House Ethics Committee, which he claims would clear him. Since then, the panel has launched an inquiry.
In police footage that CNN was able to get in June, Emily Moreno details Miller's alleged assault in an emotive manner, including one episode in which she claims he put a gun to her. Miller declares his ex-wife "manipulative," claims she suffers from mental illness, and denies ever abusing her in separate police interviews.
