Trump requests that the judge postpone his hush money conviction sentence on Friday
The president-elect is requesting a stay of Friday's scheduled sentencing and is appealing Judge Juan Merchan's two decisions that rejected his attempts to overturn his conviction in the hush money case.
Trump's plea is being made four years after he attempted to overturn his election defeat and his supporters rioted at the US Capitol, and on the same day that he will be officially declared the winner of the 2024 presidential election.
Merchan scheduled Trump's sentencing in the hush money case for Friday, rejecting Trump's bid to have his conviction overturned since he was elected president. However, Merchan made it clear that he would not be giving Trump any jail time.
Trump's attorneys contended that the sentencing ought to be halted while his appeals are pending. Merchan has been requested to respond by Monday at 2:00 PM ET.
"This case should never have been brought in the first place, and the Court should vacate the sentencing hearing scheduled for January 10, 2025, and suspend all further deadlines in the case until President Trump's immunity appeals are fully and finally resolved," according to Trump's filing.
In order to prevent adult-film star Stormy Daniels from speaking out about an alleged affair prior to the 2016 election, Trump paid $130,000 in hush money to his then-attorney Michael Cohen. In May, he was found guilty on 34 charges of falsifying company documents. (The affair has been denied by Trump.)
Originally scheduled for sentencing in July, Trump's sentencing was postponed until after the election due to the Supreme Court's decision regarding presidential immunity. Merchan, however, denied Trump's request to have the lawsuit dismissed on the grounds of presidential immunity last month.
